Terms of Service, Simplified

The FreddyWare Solutions Enterprise Network (http://www.freddyware.net/) owns and operates its subsidiary, FreddyWare Web Services (http://www.freddyware.org/), which is the operator of PersonalLog (this site). PersonalLog (the Service Provider) makes available free blog hosting for anyone registering with us, under the conditions set out by our Terms of Service.

This is the “Simplified” version of our Terms of Service, intended to be understandable by a person educated in English.

PersonalLog users must agree to our Terms of Service in order to continue to use the service, and must comply with its regulations and the terms of our privacy policy, as well as other agreements of FreddyWare Web Services. All of our applicable agreements are made publicly available on our web sites.

Users of PersonalLog’s blog hosting service must use our services legally, meaning that you must not violate any laws in or through their use of our service. In particular, bloggers may not violate copyright and trademark regulations in the municipality in which they live, and may not violate such regulations as defined in Ontario, Canada.

You may not post or link to material that is unlawful, threatening, abusive, malicious, defamatory, obscene, profane or otherwise objectionable in any way. PersonalLog, FreddyWare Web Services, and the administration of the FreddyWare Solutions Enterprise Network (FWSENET) will determine what is in violation of this policy.

In particular, blogs may not discuss the following:

  • Pirating of software, music, videos, and multimedia (including warez)
  • Pornography or adult content of any form
  • Drugs, illegal medications, and adult-targeted medications
  • The violation of one’s privacy
  • Guns, weapons, ammunition, and explosives of any sort
  • The violation of any laws where the user resides, works, or in Ontario, Canada
  • Blackhat search engine optimization techniques
  • Controversial politics and religion
  • Controversial historical topics, including WWII, the Cold War, the Korean War, the Vietnam War, and the Iraq War

Additionally, blogs and their authors must not:

  • Participate in software/multimedia copyright violation (pirating and warez)
  • Participate in the trafficking of drugs, guns, weapons, ammunition, explosives, or pirated media
  • Participate in the violation of common laws and governmental legislation
  • Participate in the violation of copyright law (text, graphics)
  • Violate any contracts that one has committed to

We will permit:

  • Critical analysis of politics and religion, as well as historical topics (neutral stance preferred)
  • Critical analysis of blackhat SEO (neutral or critical stance)
  • Proper and reputable search engine optimization
  • Critical analysis of copyright violation (neutral or legal stance only)
  • Critical analysis of current laws (neutral or common stance)

You may not promote your blogs through unsolicited e-mail (SPAM), and may not use our server to send SPAM. We will charge users a punitive fee for each message sent that is in violation of this policy, as determined by FreddyWare Web Services and the administration of FWSENET.

In using our blog hosting, you also acknowledge that PersonalLog, FreddyWare Web Services, and the administration of FWSENET will always have access to your blog(s), and may remove any content (deemed to be questionable) without notice. In particular, blogs may not host or reference warez, pirated music, or other pirated multimedia.

If you believe that the security of your blog has been compromised — in that questionable content or actions are appearing without your consent — contact FreddyWare Web Services or the administration of FWSENET immediately. The compromise of your security may lead to the compromise of ours. For that reason, we will treat all such claims seriously. (However, please check whether it was a user registered with your blog that you have promoted to a higher status.)

You agree that, to use our service, you must be at least 13 years of age. You also agree that — although content may be targeted to children under that age — you will delete any registered members below that age.

You agree that FreddyWare Web Services and the FreddyWare Solutions Enterprise Network will not be responsible for downtime or other unavailabilities of your blog(s), although such downtime has never occurred.

You agree that PersonalLog, FreddyWare Web Services, and the administration of FWSENET have the ability at all times to archive, delete, or “mark as SPAM” blogs for violation of these terms. You also agree that these parties may archive or “mark as SPAM” in their sole discretions for perceived violations of these terms or applicable laws.

You agree to indemnify us and hold us harmless for any breach by you or claims against us by a third party for all claims, actions, proceedings, losses, liabilities, damages, costs, and expenses arising due to your breach of our Terms of Service (or other applicable documents).

PersonalLog, FreddyWare Web Services, and the administration of FWSENET may update (revise, amend, modify) these Terms at any time, and will make such changes sufficiently known through a post on our site. It is your responsibility to make sure that you are in compliance with any changes. (If you choose not to accept changes, we will allow you to take a backup, and will subsequently terminate your account.)

Finally, you acknowledge that subtle differences between the ways that the Simplified version and the legal text are interpreted will not release you of liability. The legal text remains at all times the official document, and where the Simplified version contrasts, the legal text will always remain definitive.
